    Liability Waiver 

    This Liability Waiver and Release of Liability (“Waiver”) is made and entered into on this day by and between THE GYM INC DBA SANDBOX FITNESS CLUB, a California entity(the “GYM”), and (the “MEMBER”).

    1. ACKNOWLEDGMENT OF RISK
    The MEMBER acknowledges that participation in the activities, classes, programs, and services offered by the GYM (the “ACTIVITIES”) involves inherent risks and dangers, including, but not limited to:
    • Physical injury or harm
    • Exposure to illness or infection
    • Property damage or loss
    • Exposure to other hazards or risks associated with the use of the GYM’s facilities, equipment, and services

    ​2. RELEASE OF LIABILITY
    The MEMBER hereby releases, holds harmless, and indemnifies the GYM, its officers, directors, employees, agents, and representatives (collectively, the “RELEASED PARTIES”) from any and all claims, demands, actions, causes of action, suits, damages, losses, costs, expenses, attorneys’ fees, and liabilities of every kind and nature whatsoever that may arise from or relate to any bodily injury or property damage occurring as a result of the MEMBER’s participation in the ACTIVITIES.

    3. INDEMNIFICATION
    The MEMBER agrees to defend and hold harmless the RELEASED PARTIES from any and all claims, demands, actions, causes of action, suits, damages, losses, costs, expenses, attorneys’ fees, and liabilities of every kind and nature whatsoever that may arise from or relate to any bodily injury or property damage occurring as a result of the MEMBER’s participation in the ACTIVITIES.

    4. DISCLAIMER OF WARRANTIES
    The MEMBER acknowledges that the GYM makes no warranties or representations regarding the safety or suitability of its facilities, equipment, or services. The GYM shall not be liable for any injuries or damages resulting from any defects in the facilities or equipment.

    5. MEDICAL CLEARANCE
    The MEMBER represents that they are physically fit and able to participate in the ACTIVITIES. If the MEMBER has any medical condition that may affect their ability to participate in the ACTIVITIES or have any concerns about their health or physical condition, they must disclose this information to the GYM prior to participating in any ACTIVITIES.

    6. CONSENT TO TREATMENT
    In the event of an emergency or injury requiring medical attention during the ACTIVITIES, the MEMBER hereby gives permission to the GYM to obtain medical treatment for them from qualified medical personnel.

    7. GOVERNING LAW
    This Waiver shall be governed by and construed in accordance with the laws of [insert state/province]. Any disputes arising out of or related to this Waiver shall be resolved through binding arbitration in accordance with the rules of [insert arbitration organization].

    9. AMENDMENTS AND MODIFICATIONS
    This Waiver may not be amended or modified except in writing signed by both parties.

    This Waiver shall be binding upon and inure to the benefit of the parties hereto and their respective successors and assigns.
    By signing below, I acknowledge that I have read and understood this Liability Waiver and Release of Liability and agree to be bound by its terms.
